I think you are splitting legal hairs here, but the Constitution is subject to a few reasonable interpretations. Yours could be correct.

There is also the aspect of "traditions." They may not be legally sound, but because they have been done for so long, it's hard to dislodge them. Even if your interpretation is right, there will be many to fight back: some for the sake of tradition, others for the sake of politics.

For example, the King/Queen of English has a veto over bills going through Canadian Parliament. But tradition says it will not be used. And it hasn't.

It would be quicker to build the TDG than to move the USA in the direction you think it should go.
