I'm not a legal expert, but it seems until there is an actual conviction (of insurrection), the name proffered by the Republican Party has to be on the ballot. Otherwise, there becomes a precedent for any state to refuse any name they don't like.
While many Medium contributors were jumping for joy over the Colorado decision, they seem to leave out that the decision was only 4-3 in favor. Not exactly a full legal endorsement here.
