I find it ironic that advocates for "states rights" will take this case to SCOTUS.
As a non-legal person, I would say the definition of insurrection is vague. In my mind (and a few others), a true insurrection would involve some sectors of the military or police willingly co-operating with the insurrectionist. There was no such co-operation from what I could see. But I am a non-legal person.
January 6, 2021 was an attempt to create a constitutional crisis, where legal authority is uncertain. In such a state, "bluff and bluster" just might come out on top.
