If what you are saying is true, then it seems to me that the Supreme Court is the arbitrator of the division of rights or powers or responsibility or authority between the states and the federal government. With no document to guide them or even steeped tradition, the Supreme Court of the Day could take or give as it sees fit. We could see Washington DC civil servants deciding on which potholes to fix in Alberque New Mexico. Or maybe SCOTUS could declare the election in California is fraudulent and its EC votes actually belong to the R's. That is what I am getting from your interpretation.
As for the 108 million voters who sat on the sidelines in 2016, I would say that is their right to do. If I were an American in 2016, I probably would have sat out the election as well.
Australia has an incentive to vote and usually gets 90%+ compliance. I don't see Australia as being governed much better than other western democracies. To me, chastising the non voters is a moot point.
I would even say that that non-voting block is the strongest voting block in the USA for just even 10% of them could affect the result. Politicians really should be careful not to upset them. For example, Mr. Trump did himself no favors holding up that Bible in front of the church. That particular act is likely to convince enough of the non-voters to vote next time.
The Trump base is going to be a serous social/political force for at least the next decade. Mr. Biden seems likely to win, and his administration will be beset by this group for every wink, nod, or tinkle it makes. We will continue to see paralysis in Congress and disunity in the D party and the political left. There is no plan other than "not Trump."
In some ways, it might be better to let Mr. Trump win and let him clean up his own mess. In that way, enough of the T base will desert him, realizing the errors of their ways. But as things sit now, they will blame Mr. Biden--and be a solid big force in 2024, maybe even 2022.
The American system is broken. It is time for a new way.
